Legal information

Terms and conditions

These terms govern your use of the coal.marketing website and set out the general principles of our services. For each project, the signed quote is what counts.

Updated

In these terms, “we” means Coal Marketing, the trading name of Liam Domenech, entrepreneur individuel (EI), whose details are in the legal notice. “You” means the site’s visitor or our client.

Using the site

The site presents Coal Marketing, its services and its work, and lets you get in touch with us. By browsing it, you accept these terms.

Access

The site is free to access. Your internet connection costs remain your own.

Intellectual property

Unless stated otherwise, the site’s text, visuals and code are © Coal Marketing. Any full or partial reproduction or reuse without our prior written consent is prohibited.

Work done for our clients is shown with their permission. Trademarks, names and logos mentioned belong to their respective owners.

External links

The site links to other websites, such as our clients’. We do not control their content and are not responsible for it.

Availability

We do our best to keep the site available at all times, but it may be interrupted without notice, for example for maintenance or in case of an outage.

Liability

Information published on the site, including the guides and price indications, is given for guidance only and may change. It replaces neither a quote nor advice tailored to your situation. We cannot be held liable for indirect damage arising from using the site or being unable to access it.

Personal data

The data you send us is handled as described in the privacy policy.

Services

Every engagement is governed by a written quote (devis) or contract that sets out its scope, deliverables, price, schedule, payment terms and the transfer of rights. If they conflict, the quote or contract prevails over these terms.

Quotes and kickoff

Our quotes are free. A project starts once the quote is signed.

Content supplied by the client

You remain responsible for the content you supply (text, photos, logos, trademarks…) and guarantee that you hold the rights needed for it to be used in the project.

Rights to deliverables

Rights to the deliverables are transferred to you once the price has been paid in full, on the terms set out in the quote (rights transferred, uses, duration, territory).

Unless you object, we may show the work in our portfolio. If you would rather we didn’t, just tell us.

Late payment (business clients)

Any late payment automatically incurs, with no reminder needed, late-payment penalties at the rate set by Article L441-10 of the French Commercial Code (the rate applied by the European Central Bank to its most recent refinancing operation, plus 10 percentage points), as well as a fixed €40 indemnity for recovery costs.

Consumers

If you are a private individual and the contract is concluded at a distance (by email, for example) or off-premises, you generally have 14 days from its conclusion to withdraw, without giving any reason, under the conditions of the French Consumer Code. If you asked for the work to start before that period ends, the part already performed remains payable if you withdraw.

If a dispute remains after a written complaint to us, you can turn to a consumer mediator free of charge.

Governing law and disputes

These terms are governed by French law. If a problem arises, please email us first at contact@coal.marketing: we will look for an amicable solution.

Failing agreement, any dispute with a business falls under the exclusive jurisdiction of the courts of Montpellier. If you are a private individual, you may bring the matter before the court where you live or any other court with jurisdiction under the law.

Changes to these terms

We may update these terms. The version that applies is the one online when you visit; for a service, it is the version in force when the quote is signed.
